Ritar Service Agreement & Terms of Use

Welcome to the Ritar software service platform. This document (the "Agreement") governs the relationship between you (the "User") and Ritar International Group,. (referred to as "Ritar"). These terms apply to all monitoring and data services accessed via the Ritar ecosystem, whether through a web browser, mobile application, or any other compatible hardware.

I. Preliminary Provisions

1. User Consent: To safeguard your interests, please review these terms thoroughly before registering for our remote monitoring services. By clicking "I Accept" or by accessing any Ritar services, you enter into a legally binding contract. You affirm that you possess the full legal capacity to enter this agreement (e.g., you are of legal age) and, if acting on behalf of an entity, you possess the authorized power to bind that organization.

2. Regional Restrictions: If the laws of your local jurisdiction prohibit or invalidate any portion of this Agreement, you must cease using the Ritar monitoring platform immediately.

II. Mutual Responsibilities

1. Obligations of Ritar

  • Platform Maintenance: Ritar is responsible for the development, hosting, and operational management of the monitoring interface to ensure consistent service delivery.

  • Support Services: Ritar shall provide technical consultation channels (such as help desks or contact lines) to assist Users with platform-related inquiries.

  • System Errors: In the event of a platform-side failure that disrupts service, Ritar commits to resolving the technical issue with due diligence and urgency.

2. User Responsibilities

  • Compliance: Users must adhere strictly to the operational guidelines and security protocols established by Ritar.

  • Data Integrity: You agree to provide accurate and current registration details (including email addresses and hardware serial numbers). Ritar is not liable for issues arising from false, outdated, or incomplete information.

  • Intellectual Property Protection: Unless granted express written permission by Ritar, Users are prohibited from duplicating, distributing, modifying, or creating derivative works based on the platform’s content.

  • Account Security: You are solely responsible for maintaining the confidentiality of your login credentials. Ritar is not liable for losses resulting from unauthorized access due to your negligence. If you suspect a security breach, notify us immediately.

  • App Maintenance: Users acknowledge that significant software errors may require a manual reinstallation of the mobile application to restore full functionality.

III. Ownership and Proprietary Rights

  • Data Ownership: You retain ownership of the data generated under your account. You grant Ritar a license to process this data to provide and improve your services. We may disclose data if required by law or regulatory authorities. Details are available in our Privacy Policy, found on the Ritar official website.

  • System Rights: Ritar retains all title and intellectual property rights to the remote monitoring system, including all code, graphics, text, and proprietary algorithms. These are protected by international copyright and trademark laws.

  • Limited License: Ritar grants you a non-exclusive, non-transferable, and revocable right to use the platform. You may not resell the service or infringe upon Ritar’s patents.

  • Remote Updates: To ensure system stability, Ritar reserves the right to perform remote firmware upgrades or configuration adjustments without prior notice, using non-personal technical data.

IV. Rules of Conduct

1. Information Accuracy: You must update your profile promptly if your contact information changes. Ritar disclaims liability for data discrepancies or analysis errors caused by incorrect User input.

2. Privacy Best Practices: For your security, we recommend using aliases rather than real names for nicknames. Note that using an email address as a login identifier makes that address visible to the system administration.

3. Prohibited Uses: When using the Ritar platform, you shall not:

  • Violate any local or international laws.

  • Upload or transmit defamatory, obscene, or infringing content.

  • Engage in activities that damage the reputation or rights of third parties.

4. Indemnification: The User agrees to indemnify Ritar against any third-party claims arising from the User’s specific use of the platform or associated products.

5. Evidence Disclaimer: Data provided by the Ritar platform is for reference and self-monitoring only; it is not intended for use as certified evidence in legal or arbitration proceedings.

V. Liability Disclaimers

  • Data Precision: While we strive for accuracy, Ritar does not guarantee the absolute completeness of the data. We are not responsible for errors caused by User non-compliance with these terms.

  • Service Interruptions: Ritar is not liable for outages caused by force majeure, internet service provider failures, or other factors beyond our reasonable control.

  • Hardware Issues: For malfunctions related to Ritar-manufactured data collectors or server-side lag, Ritar will act responsibly to rectify the fault as quickly as possible.

  • General Limitation: Ritar shall not be held liable for any financial or physical loss resulting from the use of the platform unless such loss is proven to be the result of Ritar’s intentional misconduct or gross negligence.

VI. Termination and Suspension

  • Causes for Interruption: Services may be suspended due to scheduled maintenance, external network failures, the provision of false User information, or a breach of any section of this Agreement.

  • Notice: Ritar will attempt to provide advance notice for scheduled downtime whenever feasible.

VII. Amendments to Terms

  • Ritar reserves the right to modify these terms to reflect legal changes or operational updates. Updated versions become effective immediately upon being posted to the website.

  • Continued use of the platform after changes are posted constitutes your acceptance of the new terms.

VIII. Governing Law and Jurisdiction

  • Amicable Settlement: Both parties agree to attempt to resolve any disputes through friendly negotiation first.

  • Legal Venue: Should negotiations fail, the dispute shall be submitted to the courts located in the jurisdiction where Ritar is headquartered.
